FENCES

(*See Article 72, Section 4 of Town By-Laws; Section IV-A.8 of Zoning By-Laws.)

 

¨      Fences must be installed one (1) foot in from the property line.

Ø      This may be waived if a letter is received from the affected abutter stating it is permitted to place the fence closer to or on the property line.

 

¨      Fences must be installed no taller than six (6) feet, unless on a corner lot.

Ø      Special Permits may be obtained from the Special Permit Granting Authority.

 

¨      Fences on corner lots must be installed either: A) fifteen (15) feet back from the edge of the right of way at the intersection, no taller that six (6) feet, or B) one (1) foot in from property line, no taller than three (3) feet within that fifteen (15) foot area (see diagram below).

Ø      Special Permits may be obtained from the Special Permit Granting Authority.

 

¨      Fences shall be installed with the finished side facing the abutter and the frame side facing towards the property that is being fenced. 

 

¨      The property owner shall have access to the abutter’s side of the fence for maintenance and repairs, but not for storage purposes.

 

¨      A Building Permit is required. 

Ø      A plot plan must be submitted with the permit application showing where the fence will be located and showing setbacks.

SHEDS

¨      Under 6’x8’

Ø      Shed must be installed conforming to the setback requirements of at least six (6) feet from the side and rear property lines and at least ten (10) feet from any other structure.

Ø      No accessory structure shall be located within the front yard.

Ø      Shed shall not be any higher than ten (10) feet.

à        Variances may be obtained from the Zoning Board of Appeals.

Ø      No Building Permit is required.

 

 

¨      6’x8’ to 10’x12’

Ø      Shed must be installed conforming to the setback requirements of at least six (6) feet from the side and rear property lines and at least ten (10) feet from any other structure. 

Ø      No accessory structure shall be located within the front yard.

Ø      Shed shall not be any higher than ten (10) feet.

à        Variances may be obtained from the Zoning Board of Appeals.

Ø      A Building Permit is required.
