The Meeting was called to order at 7:00 by Chairman, Matthew Gardner. Members present: George Bain, Kathy Rehl, Jason Makofsky, Jennifer Ducey, Bernie Raftery, Doug Shepard
Discussions
Roche Bros. Parking Lot
Repaving project, total of 200,000 sq. ft. lot. Commissions requested:
1. NOI
2. Land Disturbance Permit (if required)
a. Current stormwater system is sufficient (will check with Bob Bois)
3. O & M plan – make sure current system is working properly. If undersized, requesting it be fixed.
4. Fencing around detention pond.
Mr. Raftery – All options are being considered. If decision is to resurface only, an RDA filing would be sufficient.
Restoration Plan – Waterview Estates
Mr. Singh presented a contingency plan if something is found during construction. If there is a disturbance, this is the proposed plan.
Lot 3A is a proposed custom home and homeowner is advised of this plan. Lot 2 is being sold and potential buyer is aware he will have to change plan. Lot 2 is limit of work.
Kathy Rehl questioned the proposed planting species and feels would be destroyed by deer. Too much arborvitae, holly, hydrangea and yews. It is really the owner’s choice, but recommends the removal of American Ivy, which can be very invasive and would like to see that changed. All other plants are at their risk.
Ms. Rehl suggested Boxwood as a good substitute for yews.
Mr. Gardner made a motion to approve the restoration plan, as amended by Kathy Rehl, George Bain so moved, Bernie Raftery seconded, all in favor 7-0.
Notice of Intent continuation & Land Disturbance Permit – Gardner Museum Green House
Steve gave an update on the compost system. Reviewed grey water system for sink water, no system for toilet. Will generate 20-30 gallons of grey water per day. Reviewed leeching line and passed out plans.
Mr. Raftery read comments DEP made on project. “Details of rain garden construction should be provided. Test pits should be made at infiltration sites and ESHGWT should be determined to insure a minimum of 2 feet of separation between bottom of rain garden and ESHGWT.”
Kathy Rehl reviewed chemicals used and is concerned that the inert ingredient, anti-freeze, might end up in compost. Bruce Fulford, City Soil & Greenhouse Co., stated if it landed on leaf surface on floor, it would be a food sources for bacteria. Their intent is for it not leaving the green house at all. Would be distributed moderately in compost, and broken down by bacteria into sugars, carbon dioxide and water.
Matthew Gardner stated he did some research and feels totally confident if greenhouse is built as designed, it will work.
Mr. Makofsky - stated hand sump pump goes right to compost area and sub will be emptied by hand. Asked will staff be trained on issues such as gas, oil, chemical spills, etc.
Doug Shepard moved to close, George Bain seconded, all in favor 7-0.
Mr. Shepard moved to issue standard Order of Conditions, with special conditions:
1. Notice to inspect hay bales.
2. Management of compost pile. Come back first one or two years after completion to give update.
3. Standard operating procedure for how sub is handled, maintained and managed.
4. Detailed operating procedure for the handling and management of chemical spills.
Kathy Rehl seconded, all in favor 7-0.
Bernie Raftery motioned to close and issue Land Disturbance Permit, Jason Makofsky seconded, all in favor 7-0.
ANRAD continuation – 0 Hunter’s Lane – Land Disturbance Permit
Dan Nitzsche, third party review, went over his findings and revisions as stated in his report to Commission. Going by soil samples, ditch is non regulated.
Ms. Rehl asked if any evidence of vernal pool on site. No, some pooling water, self leveling, no breeding habitat.
Jody Franklin, Presbrey Place, stated there has never been testing in late February and March, and feels it has all the characteristics of vernal pool.
Mr. Raftery asked if the applicant is asking for boundary on site. Confirm the resource area on site. Mr. Nitzsche stated it’s not certified and he didn’t see any data or anyone providing evidence. Is comfortable with Wetland flags.
Motion made by George Bain to close and approve ANRAD as revised after 3rd party review and approve the delineation as proposed, seconded by Kathy Rehl, all in favor 7-0.
Notice of Intent continuation – 0 Pleasant Street
Dan Nitzsche presented new plan after talking to third party review. Discussed his concerns about project. The two parties have been going back and forth today. Matthew Gardner needs to see email to clarify what has been changed and the new conditions presented.
Mr. Nitzsche stated the stormwater goes through system. Mr. Gardner asked if by changing location, is there any potential of shifting boundaries of wetland? No, volume will be the same proposed as existing. Will there be any change downstream?? No, no new water, all the same. It’s a sediment trapping system.
Mr. Bain – referenced letter – highly unlikely this is a perennial stream. The volume is not going to change, the velocity may be reduced. Not expected to be more impacted, and not expected to impact the abutter’s property if work is done as described.
Mr. Raftery asked to explain the wetland flag movement. Mr. Nitzsche explained the flagging. 1-7 was fine, 8 and 10 changed on plan.
Jeff Merrill, from Dover, asked if direction of stormwater going downhill or pushed further in property? Mr. Gardner stated the location of stormwater will change slightly, but same volume. The Commission and Applicant’s consultants said it will not fundamentally change the wetland. If there was a project proposed, they would be required to come before Commission. This project, as describe, will not change the wetland, based on expert testimony. Mr. Merrill concerned with having no recourse.
Mr. Gardner would like a final sign off from Mark Coviello before closing and conditioning this project.
Attorney stated his client does not have plans for future development.
Mr. Raftery motioned to continue for receipt of letter from Town Engineer and letter from Baystate confirming the completion of the third party review, Jason Makofsky seconded, all in favor 7-0. Continued to March 4th.
Certificate of Compliance – 45 Wellesley Road
Commission reviewed proposed and as built plans and questioned the retaining wall. Would like a discussion with engineer before approving Certificate of Compliance. Mr. Gardner made a motion to continue to March 4th, Jason Makofsky so moved, George Bain seconded, all in favor 7-0.
