NOTICE TO BIDDERS
Pursuant to Chapter 30B, Section 15 of the Massachusetts General Laws (M.G.L. c. 30B, §15), the Town of Natick, Natick Town Hall, 13 East Central Street, Natick, MA 01760 (“the Town”), acting through the Natick Board of Selectmen, invites the submission of bids in an online auction to dispose of the following surplus vehicle:

Note/ Special condition: This vehicle runs, drives and operates. This vehicle is a K-9 unit. This vehicle will be sold with K-9 cage as pictured and lights and siren. This vehicle has factory Ballistic door panels.
This vehicle should not be sold to someone allergic to dogs - the Town disclaims all responsibility for damage done to persons or property because of past use of this vehicle. Certain dog hairs/smells/fibers may linger. The vehicle is also being sold with blue lights and with the dog cage assembly. The Town makes no representation that the vehicle may be driven with such blue lights on it. A civilian buyer may be responsible, at his/her/its own cost and expense, to remove such lights prior to registering the vehicle under applicable state law.

The online auction shall open as of December 20, 2018, and shall on January 31, 2018 (4:00 P.M., but may extend in keeping with the rules of the auction site.) No questions will be answered from December 22, 2018 to December 31, 2018. No late or conditional bids will be accepted. Bids may NOT be placed directly with the Town, but must be processed through the auction website.
Note that if the bid will exceed $10,000, the Town reserves the right to cancel the auction, fully advertise the vehicle in accordance with M.G.L. c. 30B, §15, and to repost the vehicle for sale post-advertising. (NOTE THAT, DUE TO THE INCREASING PRICE, THE TOWN HAS EXTENDED THE AUCTION AND IS FULLY ADVERTISING THE VEHICLE IN COMPLIANCE WITH M.G.L. c. 30B, §15!)
Inspection of said vehicle may be performed either (1) at the above website or (2) in person by visiting the Natick Public Works Department, 75 West Street, Natick, MA 01760, during regular business hours, Monday through Thursday, between 8:00 A.M. and 4:00 P.M. EDST, and Friday, between 8:00 A.M. and 12:00 P.M. (noon) EDST.
The vehicle will be sold, if at all, to the responsive bidder offering the highest price for the vehicle described in this notice and on the auction site listing. The Town of Natick reserves the right to reject any and all bids and to dispose of the vehicle through a negotiated sale, provided that the negotiated sale price is higher than the highest bid received from a responsive bidder.
Upon winning the auction, the winning bidder shall be required to submit a signed non-collusion form to the Town of Natick prior receipt of the vehicle. Said non-collusion form shall state as follows:
“The undersigned certifies, under penalties of perjury, that its Bid has been made and submitted in good faith and without collusion or fraud with any other person. As used in this certification, the word “person” shall mean any natural person, business, partnership, corporation, union, committee, club or other organization, entity, or group of individuals.”
The winning bidder shall also certify that, pursuant to M.G.L. c. 62C, §49A, that it is in compliance with all laws of the Commonwealth of Massachusetts pertaining to taxes, to the reporting of employees and contractors, and to the withholding and remittance of child support.
Payment in full, in the form of electronic payment to publicsurplus.com is required prior to pickup. It shall be the seller’s responsibility to pick up all goods in person, within ten (10) days, from Natick DPW, after payment is made in full. Delivery of goods is buyer’s responsibility. Goods shall be sold as is, where is. Seller disclaims any and all warranties, including those of merchantability and fitness for particular purpose.
Buyer to pay any applicable sales tax upon registration.
